How litigation finance works

A strong claim, without the capital to run it.

A litigation funder pays the costs of a legal claim. In return, it takes an agreed share of whatever the claim recovers.

What decides the outcome is the strength of the claim, whether the other side can pay, and how long it takes. Not the FTSE, the S&P or interest-rate headlines.

Case file
  1. 01

    The claim

A claimant has a case worth bringing but can't fund it to the end.

  2. 02

    The funding

A funder pays some or all of the legal costs, in exchange for an agreed share of any recovery.

  3. 03

    The resolution

The claim settles or goes to judgment.

  4. 04

    The distribution

Proceeds are paid out under the terms agreed at the start.

Success

The funder is paid its agreed share of the proceeds.

The part most pages leave out

What can go wrong, in plain English.

Cases lose

A losing claim can mean losing everything allocated to it.

Cases run long

Courts and settlements keep their own timetable. Plans built on a date can slip.

Winning isn't collecting

A judgment is only worth what the other side can actually pay.

Money is tied up

There's usually no way to sell out of a case part-way through.

Concentration

One case is one outcome. Spreading across several changes the picture.

Which is why the Investment Centre shows you the due diligence, not just the deal.
